General Terms & Conditions

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person visiting this website and is compliant to Advantus’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing laws of India. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

ALTERATION OF THE ADVERTISED PACKAGE

Advantus shall use its best endeavours to adhere to the advertised package disclosed to the Client prior to the date of publishing or agreements, but such package and/or agenda may be altered, or parts thereof omitted or dates thereof changed, for any cause that Advantus acting reasonably shall consider to be necessary. Notwithstanding the above, Advantus will use its best efforts to deliver the advertised package as published online. Do not rely on any oral representations given by any of our representatives. Anything given on website or communicated by email to the client failing which, the Client is entitled for a full claim.

LIMITATION OF LIABILITY

Advantus shall not be liable for any special, consequential, or incidental damages arising out of this agreement or the services provided hereunder, including but not limited to damages for lost profits, loss of use or any damages or sums paid by the Client to third parties, even if Advantus has been advised of the possibility of such damages.

PRIVACY AND DATA PROTECTION

Advantus is granted the right to use, for promotional purposes, any material created or designed or developed for the client as per the requirement whether in image, photographic, audio or audio-visual format, without time limitation and in any format. The client hereby gives up any privacy right he might have and accepts not to enter into any legal proceedings against Advantus arising from use of such produced material. The data filled in this form will be stored and used for obvious logistic and communication purposes. Advantus will not sell or disclose them to any third party.

MISCELLANEOUS

This agreement constitutes the sole and exclusive agreement between the Advantus and the Client. The Client acknowledges that no other warranties, representations or acknowledgements, written or verbal, have been made that are not reflected herein. These terms and conditions may not be changed by Advantus without the written confirmation of a director thereof, and, in any event, no such change shall be effective unless made in a writing signed by Advantus and an authorized representative of the Client.

The names of all authorized directors of Advantus will be provided upon request. Time is of the essence in relation to this agreement. This agreement shall be binding upon all the parties upon execution and delivery to the other party of this contract. Delivery by email shall constitute delivery hereof.

Notices or communications in connection with this agreement shall be sent via email and shall be sent to the Parties (Advantus and the Client) as follows: Notices sent via email shall be deemed to be received at the time of delivery. All notices sent on a day other than a business day shall be deemed to be received on the immediately following business day. The construction, validity and performance of this agreement shall be governed in all respects by the laws of Bengaluru, India to the exclusive jurisdiction of the court in Bengaluru, India.

LICENSE

Unless otherwise stated, Advantus and/or its licensors own the intellectual property rights for all material on Advantus. All intellectual property rights are reserved. You may access this from Advantus for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Republish material from Advantus.
• Sell, rent or sub-license material from Advantus.
• Reproduce, duplicate or copy material from Advantus.
• Redistribute content from Advantus.

Any such information, content or material that belongs to Advantus, which we have reason to believe will discredit the organization or is defamatory or breaches the intellectual property rights as set out per the above will be a violation of the general terms & conditions. Such information will be required to be taken down with immediate effect.

HYPERLINKING

The following organizations may link to our Website without prior written approval:

• Government agencies;
• Search engines;
• IT and Software Brands;
• News organizations;
• Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and
• System-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.

These organizations may link to our home page, to publications or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party’s site.

We may consider and approve other link requests from the following types of organizations:

• Commonly-known consumer and/or business information sources;
• dot.com community sites;
• Associations or other groups representing charities;
• Online directory distributors;
• Internet portals;
• Accounting, law and consulting firms; and

We will approve link requests from these organizations if we decide that: (a) the link would not make us look unfavourably to ourselves or to our accredited businesses; (b) the organization does not have any negative records with us; (c) the benefit to us from the visibility of the hyperlink compensates the absence of Advantus; and (d) the link is in the context of general resource information.

These organizations may link to our home page so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s site.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to Advantus. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link.

Approved organizations may hyperlink to our Website as follows:

• By use of our corporate name; or
• By use of the uniform resource locator being linked to; or
• By use of any other description of our Website being linked to that makes sense within the context and format of content on the linking party’s site.

No use of Advantus's logo or other artwork will be allowed for linking absent a trademark license agreement.

CONTENT LIABILITY

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are rising on your Website. No link(s) should appear on any Website that may be interpreted as libellous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

RESERVATION OF RIGHTS

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

REMOVAL OF LINKS FROM OUR WEBSITE

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly.
